Criminal Investigations and Prosecutions

Finding yourself under investigation for a criminal offence, no matter the surrounding circumstances, is likely to be an extremely daunting prospect. This is especially true if you are unfamiliar with how the criminal investigation process works, or what to expect both in the short and long-term.

If you are facing a criminal investigation, or criminal charges, it is absolutely imperative that you instruct expert legal representation as soon as possible. This is something our experienced team of criminal law solicitors can provide.

At Carson Kaye, our specialist criminal law solicitors have established an outstanding reputation for providing the highest standard of representation for a range of criminal offences. When instructed, our team can provide immediate support, starting at the police station and carrying through to court representation where required.

During our years of practice, we have established a strong reputation for providing robust, detailed and dynamic legal advice, with a strong track record of success.

When instructed, our team will take the time to carefully guide you through the particulars of your case and what steps need to be taken in order to achieve a positive outcome that is proportionate to the investigation at hand – including avoiding prosecution where possible.

We are aware that being investigated and prosecuted for a criminal offence can be a life-changing event. As such, you can be certain that your case will be handled with the necessary care and attention, with our team putting their extensive skills into effect from the moment they are first instructed. This is regardless of what stage your investigation may be at.

Our Expertise with Criminal Investigations and Prosecutions

Police Station Representation

It is important to understand that if you are being held at a police station, you are entitled to independent legal advice. This could be from a duty solicitor or a solicitor of your own choosing.

While duty solicitors provide a valuable service, they are unlikely to possess the skill and expertise required to provide you with the highest standard of representation at the police station. This is where the advice and support of our criminal investigation solicitors can make the difference.

You should be aware that anything you say, do not say, or agree to while you are being held at a police station can be pivotal when it comes to the final outcome of your case. Instructing expert legal counsel in the form of one of our criminal law solicitors is, therefore, likely to be a decisive factor.

Voluntary Police Interview/Interview Under Caution

A voluntary police interview (also referred to as an interview under caution) is a formal conversation with the police, usually taking place at a police station. While voluntary interviews are often less formal than interviews under arrest, conversations are still recorded, and anything you say can still be held against you during subsequent criminal proceedings.

It is, therefore, imperative that, if you are invited to attend a voluntary police interview, you instruct an expert criminal law solicitor to advise you on exactly how to proceed. Our team can provide immediate representation, adopting a proactive approach to secure a positive result.

Released Under Investigation/Released on Bail

It is common to be released under investigation or released on bail following a police station interview. If you are released under investigation or released on bail, the criminal investigation will still be considered active, and the police will not have made an immediate charging decision.

If you are released on bail, the police will have a specific window in which to make a charging decision on your case. In contrast, if you are released under investigation, there is no set time limit for the police to make a charging decision.

Schedule 4 of the Police, Crime, Sentencing and Courts Act 2022 will encourage the police to place individuals on bail in ‘every case where necessary and appropriate’, with a view to decreasing the number of people being released under investigation.

Our expert criminal law solicitors can provide detailed advice during this stage, submitting written representations to drop charges where appropriate. If, given the circumstances, it is likely that further action will be taken by the police, we can use this time to prepare your case and ensure you have vigorous representation for any prosecution proceedings.

Court Representation

If your case proceeds to either the Magistrates’ Court or Crown Court, we recognise how difficult this can be to come to terms with. Regardless, it is important to recognise the gravity of the situation, and to enlist high quality legal representation to effectively defend you throughout the entire court process.

Our team have substantial experience and expertise in providing representation in a wide range of criminal court cases, working diligently to secure the best possible result for you.

We will ensure that you are sufficiently prepared for your individual court case and that you have a comprehensive understanding of your rights and options.
